India just legalised gay sex, and this is HUGE

Now, 1/5 of the world's LGBT+ population are legally allowed to love who they want

Today, the Supreme Court in India decided to overturn Section 337 of the Penal Code, a law that criminalised gay sex – meaning it’s now legal. Seeing as India has a population of 1.3 billion people, and an estimated 78 million of these people identify as LGBTQ+, this makes it the biggest decriminalisation verdict in history.

Judges said that it violated a right to privacy. The original law, made in 1861, made “carnal intercourse against the order of nature” a crime. This law applied to anal and oral sex, so many argued that LGBTQ+ people were effectively breaking the law by having sex.

The Supreme Court has been hearing this (now v high profile) case since July. Four judges were on the case, and they all voted unanimously to scrap Section 377, describing it as ‘arbitrary’. They ruled that ‘sexual orientation of an individual is natural and discrimination on the basis of sexual orientation is a violation of Freedom of Expression’.

India’s gay prince, Manvendra Singh Gohil, was obvs emotional. He said the ruling was ‘a moment of celebration and freedom for LGBTI in India. We had our freedom taken away in 1861, but with today’s ruling our human rights will be restored’.

So yeah, this is HUGE. Congrats India!
